Statute

1. General assumption:

The GENA online store, located at the website www.gena.pl, enables purchases through the Internet within the territory of Poland, European countries, and beyond the European Union. It is owned by the headgear, complementary accessories, outerwear, and interior decoration products manufacturing facility:

The prices of goods in the online store are indicated depending on the chosen option: in Polish zlotys (PLN), Euros (EUR), and US dollars (USD), and include VAT (gross prices). The price stated for each product is binding at the time of placing the order by the Buyer. The store reserves the right to change the prices of goods in the offer, introduce new products to the store’s offer, carry out and cancel various promotional activities on its pages, or make changes to them. A sales receipt (receipt or, at the customer’s request, a VAT invoice) is standardly issued.

Customers making purchases in the online store consent to the issuance of a sales document without a signature. A properly completed form by the Buyer with the necessary information for fulfillment is a condition for a well-executed transaction. Orders with incorrectly filled registration forms will not be considered. Orders can be placed 24 hours a day, all year round. Orders placed on Fridays after 3:00 PM, on Saturdays, Sundays, and holidays will be processed starting from the morning of the next business day. If payment is not made within 10 days from the order placement, the order will be automatically canceled. This is tantamount to the termination of the sales contract. The Buyer will receive an email from the company informing about the situation and the reason for canceling the order. The Seller undertakes to protect personal data in accordance with the law of May 10, 2018.

The GENA Online Store reserves the right to refuse order fulfillment in case of errors on the store’s pages, such as displaying incorrect price or product availability information. This also applies to situations raising doubts about the authenticity of the data provided by the Customer during the ordering process.

2. Prices of goods, method, and cost of delivery

Prices of goods and delivery costs:

All prices of goods listed in the GENA online store are in Polish zlotys (PLN), euros (EUR), or US dollars (USD), and include VAT. The price stated for each product is binding at the time of placing the order by the Customer. The store reserves the right to change the prices of goods in the store’s offer, introduce new products to the store’s offer, carry out and cancel promotional activities on the store’s pages, or make changes to them.

Delivery costs in Poland: Order fulfillment in the GENA online store is carried out through the DPD courier company in Poland. For orders over 600 PLN gross, the delivery cost is free. For orders below the amount of 600 PLN gross, the delivery cost is 16 PLN gross per parcel.

Delivery cost within the European Union: In the case of shipments within the European Union, the purchase of goods is possible only with prepayment. Orders are shipped through the DPD courier company. For orders over 150 EUR, the delivery cost is free. For orders below 150 EUR, the delivery cost is 10 EUR within the European Union and 20 EUR outside the Union.

Delivery cost outside the European Union: For shipments outside the European Union, the purchase of goods is possible only with prepayment. Orders are shipped through the DPD courier company. For orders over 150 USD, the delivery cost is free. For orders below 150 USD, the delivery cost is 22 USD outside the European Union.

Payment methods:

• Payment by bank transfer or online payment (prepayment) 16.00 PLN for shipping in Poland.

• Payment by bank transfer or online payment (prepayment) 10 EUR for shipping within the EU and 22 USD for shipping outside the EU.

• Cash on delivery payment 20.00 PLN (applies to one product and only in Poland). Note that the cash on delivery shipping fee depends on the quantity of ordered products and their total value. The final cash on delivery shipping fee will be estimated right after placing the order.

A handling fee for shipping, borne by the Customer, is indicated on the sales document as a separate item.

Shipments are delivered exclusively by the DPD courier company. There is an option for personal pickup of ordered goods by the GENA online store at the manufacturer’s headquarters in Nowy Targ, at Kokoszków 54F street, Poland.

Order processing time:

Orders placed in the Gena Store are processed only on business days. Orders placed on Saturdays, Sundays, and holidays are processed on the first following business day. Order fulfillment will take place after confirmation by the Customer.

Orders for items with different processing times will be shipped once the entire order is assembled. The waiting time for the shipment ranges from 48 hours to 14 days. The waiting time consists of the order processing time (production-sewing of the product, assembling products for the order) + the estimated delivery time (24 hours for Poland and 3-7 days for shipments outside of Poland).

Delivery of goods to the Customer is carried out through the Courier of the DPD company, on business days from Monday to Friday, between 8:00 AM and 5:00 PM. The Gena Store is not responsible for non-delivery of goods or delays in delivery caused by incorrect or inaccurate address provided by the Customer or errors caused by the courier company.

3. Payment methods :

In the GENA online store, payment for the placed order can be made in the following ways:

• Cash on delivery – upon receipt of the shipment from the DPD courier (applies only to orders shipped within Poland).

• Bank transfer – to the following bank account:

Customers who choose the bank transfer option are obliged to pay for the placed order within 10 business days from the date of placing the order. Otherwise, the order will be removed from the system. In the payment title, it is sufficient to provide only the order number. It is possible to extend the payment deadline with prior notification to the GENA online store’s support.

• Fast transfer payment – Online payment authorization is carried out by the professional online payment transaction execution system PayU and PayPal. After choosing the payment option, the Customer is redirected to the service that allows authorization of the transaction.

4. Exchanges and returns:

According to the Act of March 2, 2000, “On the protection of certain consumer rights and liability for damage caused by a dangerous product,” the customer has the right to return the purchased goods from the GENA online store without stating a reason within 14 days from the date of receiving the shipment. This is possible only if the product has not been used, is undamaged, has its original packaging and labeling.

The returned or exchanged goods must be sent at the customer’s expense, along with the purchase document received and a written explanation of the reason for the return (withdrawal from the contract according to the Act) or exchange (e.g., due to a change in size) to the following address: “GENA” Katarzyna Zaręba, Kokoszków 54 f street, 34-400 Nowy Targ, Poland. The return form can be downloaded (HERE).

In the case of exchanging a product for another, the customer bears the cost of sending the product to the company’s address, as well as the cost of re-sending the exchanged product to the address specified by the customer. The GENA online store does not accept any packages sent with cash on delivery.

If a customer wants to return a product purchased from the GENA online store for exchange, they should contact the company by phone at 18 266 51 50 or by email at biuro@gena.pl. The exchange must be reported no later than 14 days from the date of receiving the shipment.

For custom-made products based on customer specifications deviating from standard dimensions and colors provided in the online store or the Gena company’s offer, there is no possibility of returning or exchanging the product.

5. Safety:

The GENA online store ensures a high level of security for both collected data and online payments. Detailed information on personal data, storage, and related rights can be found at http://gena.pl/en/privacy-policy/

Security of online payments: Payments made through PayU and PayPal transfers are supervised by a payment agent under the Electronic Payment Instruments Act, supervised by the President of the National Bank of Poland. Payments authorized by PayU S.A. and PayPal are made using the 3D Secure protocol in the form of Verified by Visa and MasterCard SecureCode.

6. Complaints:

All products offered by the GENA store are new and original, with a one-year manufacturer’s quality warranty from the GENA facility. They are also covered by the so-called “pre-sale warranty” – if you receive a product that does not match the description, contact us immediately.

Product complaints are handled in accordance with the Regulation of the Council of Ministers of July 27, 2002, on specific consumer sales conditions and amendments to the Civil Code (Journal of Laws No. 141, item 1176).

The seller’s liability for a product sold to a consumer exists for two years from the date of handing over the product to the buyer. For the consumer, this means that if a non-compliance with the contract is discovered within 2 years, they can exercise their warranty rights. The defective product should be sent at the customer’s expense with a written description of the complaint to the store’s address. Only damages resulting from improper production of products will be considered for complaints. If damages result from improper use or care of products made from natural leather or fur, Gena is not responsible for them.

The customer must include their details and order number with the shipment. The buyer will be informed about the complaint’s decision within 14 days of receiving the shipment. In the case of a positive decision, the value of the ordered goods will be refunded to the buyer’s account within 14 working days by bank transfer. In the case of repairing a reported defect, a fully valuable product will be sent back to the customer at Gena’s expense, to the address specified by the customer.

7. Delivery and Returns:

According to the Act of March 2, 2000, “On the protection of certain consumer rights and liability for damage caused by a dangerous product,” the customer has the right to withdraw from the purchase made on the Gena online store within 14 days from the delivery date without stating a reason. This is possible only if the product has not been used, is undamaged, in its original packaging, and has the label.

The returned or exchanged product must be returned with the proof of purchase and a written explanation of the reason for the return (contract withdrawal according to the law) or exchange (e.g., exchange for another size) to the following address: “GENA” Katarzyna Zaręba,  Kokoszków 54 f street, 34-400 Nowy Targ, Poland

GENA store does not accept any shipments with cash on delivery. The customer can return a product purchased through the GENA online store for exchange. In this case, they should contact the company by phone at 18 266 51 50 or by email at biuro@gena.pl. Product exchange, for example, for a different model, color, or size, must be reported no later than 14 days from the date of receiving the shipment.

Complaints do not apply to:

  • Products with mechanical damage resulting from improper use.
  • Natural wear and tear of the product.
  • Discoloration of the interior of the product made of natural leather due to sweat or strong soaking.
  • Differences in color and leather structure, as well as folds and wrinkles arising during use due to the natural properties of leather.
  • Damage or discoloration resulting from improper care or cleaning of products made from natural leather or fur.

8. Instructions for using GENA products:

Products made by GENA from sheepskin, fox fur, and rabbit fur are made from natural materials and may have color differences and physical changes such as shading and creasing. There may also be minimal differences in the structure and thickness of the leather. These differences are not grounds for complaints about GENA products.

Natural leather absorbs moisture, sweat, and dirt to a significant extent. To maintain the original appearance of the product, it is recommended to follow basic rules for its use and maintenance, as listed below:

Care for hats and gloves:

  • Use products designed for leather care (in accordance with the manufacturer’s instructions on the packaging).
  • Clean any dirt dry; for more intense stains, you can use a damp cloth or sponge (do not use hot water). Clean the surface with a special brush for suede or use a special cleaning eraser.
  • In case of getting wet, leave the product to air dry naturally. Do not dry in tumble dryers, on radiators, or expose to prolonged sunlight, as it may cause deformation or color fading.
  • Do not iron the leather and lining, as it may cause permanent damage to the product.

Care for sheepskin shoes:

  • Apply aerosol impregnants for suede/velour before first use (follow the manufacturer’s instructions on the packaging). Do not impregnate the fur, only the surface of the leather.
  • Clean any external dirt dry, and for more intense stains, use a damp cloth or sponge with cold or lukewarm water (not hot). Do not rub too hard to avoid damaging the sheepskin.
  • Dry the shoes at room temperature, avoiding heaters, and do not expose them to sunlight. Afterward, clean the tops with a special brush for suede/velour. You can also use a special cleaning eraser.
  • Do not wash or immerse in water.
  • It is recommended to regularly comb the interior for softness and durability, and to remove dust and dirt. You can use a small brush used for combing pets.
  • After removing the shoes, it is recommended to store them with inserts inside to maintain the correct shape.
  • Shoes should be used for their intended purpose, i.e., in domestic conditions.
  • Do not use pastes and creams on velour/suede surfaces.

Care for decorative sheepskins:

  • Regularly shake and comb decorative leathers to maintain softness and remove dust and any dirt.
  • Avoid exposure to sunlight, as it may cause color fading.
  • For more intense stains, you can use water or lanolin fluid designed exclusively for cleaning sheepskins – apply it to the fur using a sponge or cloth (do not use hot water).
  • Do not immerse or wash the leather itself – clean only the fur.
  • After cleaning, the leather should slowly air-dry flat at room temperature, away from heat sources (do not use tumble dryers, radiators, or expose to sunlight).

9. Final Provisions:

All textual information and product photos on the GENA store registered under the domain name http://www.gena.pl are protected by copyright. Copying, distributing, using for commercial purposes, or presenting them on other websites without Gena’s consent is prohibited. Using photos and descriptions, in whole or in part, without the author’s permission is always a violation of copyright law, in accordance with the Act of February 4, 1994.

Product photos may slightly differ in color from the original, depending on individual monitor settings and the viewing angle. Due to the natural material from which our products are made, their color may slightly differ from that shown in the photo.

In matters not regulated by this Regulation, the provisions of the Civil Code and the provisions of the Act on special consumer sales conditions, amendments to the Civil Code, and the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product apply.

The store reserves the right to change the Regulation. Any changes to the Regulation are effective from the date of publication on the http://www.gena.pl website.

Placing an order in the GENA store signifies acceptance of the provisions of this regulation.
